As the professional accreditation body for graphic designers in Ontario, RGD occasionally hears from members asked to obtain a letter from WSIB stating that coverage is optional for our business sector.
In the past, we have assisted members in this regard and studio owners have received written confirmation from WSIB confirming that they have the option to pay into WSIB but that coverage is not mandatory.
In an effort to keep the graphic design sector in Ontario informed and compliant with any changes in WSIB industry classifications, RGD's Executive Director asked for clarification or confirmation on the following:
- Which category are graphic design studios described within?
- Is coverage mandatory for graphic design studios/agencies?
- Is registering with the WSIB now mandatory even if coverage is not?
- How can studio owners most readily obtain exemption letters if requested?
WSIB provided us with the following information:
The industry classification for graphic design studios would fall under Rate Group 962, Classification Unit 7749-000, Other Advertising Services. Employers who fall under this rate group are not required to register with WSIB as this classification falls under a By-Application industry (they can opt to have coverage but it is not mandatory).
Any employers who fall under the above category are not required to register with WSIB.
Any employer requesting an exemption letter from the WSIB must submit an employer registration form or complete an online registration form. WSIB will respond with a letter stating that they are not required to register based on their business activity.
